Terms of use
These terms govern your use of this website, which is operated by Annmaya Foundation. They are a legal agreement between you and us. Please read them before you use the site or make a donation.
Accepting these terms
By browsing this site, creating an account, or making a donation, you confirm that you have read these terms and agree to them. If you do not agree, please do not use the site. Where you use the site on behalf of an organisation, you confirm that you are authorised to accept these terms for it.
What this site is for
This site describes the work Annmaya Foundation does and lets you contribute towards it. Each package or cause states what it costs and what it provides. You choose one, you pay, and we carry out the distribution the package describes. The site is not a marketplace, and nothing on it is offered for sale: a donation is a contribution to charitable work, not a purchase of goods or services, and you receive no goods or services in return for it.
Who may use it
- You must be at least eighteen years old and legally able to enter into a contract.
- You must use your own payment method, or one you are authorised to use.
- You must give us information that is accurate and current, and correct it if it changes.
- The site is intended for donations in Indian rupees from within India. If you give from outside India, you are responsible for complying with the law that applies to you.
Donations
Every amount on this site is shown in Indian rupees and includes nothing hidden. Before you pay, the site shows you the cause, the package, the quantity and the total. Payment is taken by a licensed payment gateway; we never see your card or bank credentials.
A donation is voluntary and, once completed, is generally final. The circumstances in which we will consider a refund, and how to ask for one, are set out in the donation and cancellation policy, which forms part of these terms.
We do not guarantee that any particular tax benefit will be available to you on a donation. Whether a benefit is available depends on your own circumstances and on the registrations in force at the time. Nothing on this site is tax or legal advice, and you should confirm your position with a qualified professional.
Your account
You may donate without an account. If you create one, you are responsible for keeping your sign-in credentials confidential and for everything done through your account. Tell us immediately if you believe someone else has used it. We may suspend or close an account that is being used in breach of these terms, and we will tell you why where we lawfully can.
How you may not use the site
You agree not to:
- Use the site for any unlawful purpose, or in breach of any law that applies to you.
- Make a payment with a payment method you are not authorised to use, or attempt to launder money through a donation.
- Attempt to gain access to any part of the site, any account, or any system or network connected to it, that you are not authorised to access.
- Probe, scan, or test the vulnerability of the site, or breach or circumvent any security or authentication measure.
- Interfere with the site or place an unreasonable load on it, including by any automated means, and including any denial of service.
- Scrape, harvest, copy, or reproduce any part of the site or its content in bulk, or use it to train a model, without our written permission.
- Upload or transmit anything containing malicious code, or anything unlawful, defamatory, obscene, hateful, or infringing.
- Impersonate any person, or misrepresent your association with any person or organisation.
- Remove, obscure, or alter any notice of ownership on the site.
Content and ownership
Everything on this site — its text, photographs, illustrations, layout, design, code and the Annmaya Foundation name and logo — belongs to us or to the people who licensed it to us, and is protected by copyright, trade mark and other intellectual property law. You may view the site, and you may print or download a copy of a page for your own personal, non-commercial reference. You may not otherwise copy, adapt, publish, distribute, or commercially exploit any part of it without our written permission.
Where you send us anything — a message, an enquiry, a photograph, a suggestion — you keep whatever rights you have in it, and you grant us permission to use it for the purpose you sent it for. Do not send us anything you are not entitled to send.
Photographs of people
The photographs on this site are our own. A photograph in which someone can be recognised is published only under a recorded consent and a recorded review. You may not download, reproduce, or republish any photograph of an identifiable person from this site. If you are in a photograph here and want it removed, write to us and we will remove it.
Accuracy of what you read here
We take care that what this site says is accurate, and we correct it when it is not. Even so, the site is provided as it is: we do not warrant that it will be uninterrupted, error-free, or free of anything harmful, and we do not warrant that every description is complete or current at the moment you read it. Where a figure or a claim on this site matters to your decision, and it is not stated with a source, please ask us before relying on it.
Third-party services and links
The site relies on third parties for payments, hosting, email, sign-in and security, and it links to destinations we do not control, including our own social media profiles. We are not responsible for the content, the availability, or the practices of anything we do not operate. Following an external link is your decision, and the terms and privacy policy of that destination apply to you there rather than ours.
Availability
We try to keep the site available, but we may suspend, withdraw, or restrict all or part of it for maintenance, for security, or for a business reason, with or without notice. We are not liable to you for any unavailability. If a payment is interrupted, follow the donation and cancellation policy rather than paying twice.
Our responsibility to you
Nothing in these terms limits any liability that cannot lawfully be limited, including liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by our negligence.
Subject to that, and to the fullest extent the law allows: we are not liable for any indirect or consequential loss, for any loss of profit, revenue, business, goodwill or anticipated saving, or for any loss arising from your use of, or inability to use, the site; and our total liability to you in connection with the site and any single donation is limited to the amount of that donation.
You agree to indemnify us against any claim, loss or cost arising from your breach of these terms or your unlawful use of the site.
Privacy
Our privacy policy explains what we collect, why, who processes it, where it is held, and what rights you have. It forms part of these terms, and using the site means you accept it.
Changes to these terms
We may change these terms. The version on this page, with the date shown above it, is the one in force, and it applies to any use of the site and any donation made after that date. Continuing to use the site after a change means you accept it. If you do not accept a change, stop using the site.
Severability and waiver
If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce a right straight away, that is not a waiver of it.
Governing law and jurisdiction
These terms, and any dispute arising out of them or out of your use of this site, are governed by the laws of India. The courts of India have exclusive jurisdiction. Before starting any proceeding, please raise the matter with us: most problems are a payment or a delivery date, and we would rather fix them than argue about them.
